Activision’s Baja 1000 is selling in stores despite the fact that THQ has filed a suit against the company claiming that Activision’s International Baja 1000 looks too similar to THQ's PS3/360 Baja Edge of Control. THQ had stated that both the front and the back of the boxart look the same and apart from some other features along with the Baja logos titled up ten degrees are also identical. By this THQ has hoped that the release of the Baja 1000 would be delayed.
However, a .U.S. District Judge has stated that THQ has presented no proper evidence of hardship. He also stated that balance of hardship is in favor of Activision and that the release would be forced to halt at the last minute if it is found investing resources in developing the game.
